Our Data Protection & Privacy Policy: marketing & processing of personal data

The General Conditions of Sale of Luminata Store (e-shop) equally apply to all shopping customers.
The relationship between MiBrand OÜ, the representative of the Luminata Store, and the shopping customer is regulated by the subsequent General Conditions of Sale, the Data Protection & Privacy Policy and legislation enacted by the Republic of Estonia, member of the European Union.

1. Order validity, placement and product information

An order is formalised between the person making a purchase (hereinafter referred to as the Buyer) from the Luminata Store (e-shop) and MiBrand OÜ (reg no 12010995, located in Tallinn, Estonia), the representative of luminata.eu (hereinafter referred to as the Seller). The formalisation of an order is equivalent to the conclusion of a contract of purchase and sale.

Add the desired products to your shopping basket to order them. Please fill carefully in all of the required fields, check the data accuracy and choose the most suitable shipping method to complete the order. The Buyer is liable for the correctness of the order.

The total cost is then displayed on the screen. This can be paid via an online bank transfer or using another payment method. The contract enters into force when the amount payable is fully transferred to the bank account of the online store.

If we cannot deliver the ordered goods due to stock running out or for any other reason, the Buyer will be informed as soon as possible and the money paid (including the shipping cost) will be refunded promptly, but no later than within 14 days of receiving the notification.

2. Pricing information

The prices of the products sold in the Luminata online store are indicated next to the products and shown in euros (EUR). A fee for shipping is added to the price, payable by the Buyer, and dependent on the chosen delivery method. All prices include VAT of 20%.

The shipping cost depends on the location of the Buyer and the chosen shipping method. The shipping cost is displayed when the Buyer places the order.

Product information is provided immediately adjacent to the product in the online store.

3. Delivery of goods and delivery time

Goods are shipped only to the European Union countries.
The Buyer bears the shipping cost and the respective price information is displayed next to the shipping method.

All shipments within Estonia generally arrive at the destination specified by the Buyer within 3-7 business days of the date of entry into force of the contract of sale. All shipments outside of Estonia (and within the EU) are guaranteed to arrive within 14-30 calendar days, depending on the shipping method. We have the right to ship goods in up to 45 calendar days in exceptional cases.

Buyer is reliable for providing accurate delivery data while completing the order and will assume liability for the delay and / or additional costs of delivery in case of failing to do so.

Before accepting the order from Courier / immediately on the delivery of products, we recommend the Buyer to examine the packaging, quantities and the general conditions of products. If the product has become damaged during transport, it will be replaced with a new, undamaged product, providing that the Buyer notifies the Seller immediately (exercising the 14-day right of withdrawal, specified in the following section 4. and uses an appropriate returning method for the products, depending on the chosen delivery method. Any later complaints concerning the goods will not be satisfied.

4. Returning products and cancelling the order

After receiving the order, the Buyer has the right to withdraw from the contract entered into with the e-store within 14 days. The Buyer has no right of withdrawal for the products specified in the subsection 53 (4) in the Law of Obligations Act

The right of withdrawal does not apply if the Buyer is a legal person.

To exercise the 14-day right of withdrawal, the Buyer must not use the ordered goods in any way other than is necessary to ensure the nature, characteristics and functioning of the goods in the same way you would be allowed to test the goods in an actual store.

If the goods have been used for any purpose other than is necessary to ensure the nature, characteristics and functioning of the goods, or if there are any signs of use or wear and tear, the online store has the right to lower the amount returned in accordance with the decrease in the value of the goods.

To return the goods, the Buyer must submit a declaration of withdrawal to the e-mail address luminataofficial@gmail.com within 14 days of receiving the goods.

The Buyer shall bear the cost of returning the goods, except in cases where the reason for the return lies in the fact that a refundable product does not comply with the order (e.g. a wrong or defective product).

The Buyer must return the goods within 14 days of the submission of the declaration of withdrawal or submit evidence that they handed over the goods to the carrier within the aforementioned period.

Upon receiving the returned goods, the online store shall return to the Buyer, immediately but no later than after 14 days, all of the payments received from the Buyer based on the contract.

The online store has the right to refuse to make the refund until the goods being returned are received or until the Buyer has provided proof of returning the products, whichever occurs first.

If the Buyer has clearly chosen a different form of shipment than the cheapest usual form of shipment offered by the online store, the store is not required to compensate the cost exceeding the usual shipping cost.

The packaging of the returned goods and the goods itself may not have any damage. Goods returned in damaged packaging or damaged products will not be accepted and thus the Seller has the right to refuse to make the refund.

The online store has the right to withdraw from the sale and demand that the goods be returned by the Buyer if the marked price of the goods in the online store is significantly lower than the market price of the goods due to an error.

5. Defective goods

The online store is responsible for the non-compliance of goods sold to the Buyer with the terms and conditions of the contract or for deficiencies which already existed at the time of delivery and which occur within the period of six months from the date of purchase.

The Buyer has the right to turn to the online store within two months of the occurrence of a defect by e-mailing luminataofficial@gmail.com.

The online store is not liable for any defects arising after delivering the goods to the Buyer and for damages/deficiencies deriving from the abnormal use of the product. If the Buyer discovers that the product does not conform to requirements, he/she must promptly notify the Seller thereof. If the Buyer has used the product after having discovered the defect, his/her complaints will not be satisfied.

If goods bought from the online store have defects for which the online store is responsible, the online store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the online store shall return to the Buyer all of the payments involved in the contract of sale within 14 days after receiving the returned defective goods from the Buyer.

The online store will respond to the Buyer’s complaint in written form or in a form that enables written reproduction within 15 days.

6. Direct marketing and processing of personal data

The online store only uses the personal data entered by the Buyer (including name, phone number, address, e-mail and bank details) for processing the order and sending goods to the Buyer. The online store forwards only the needed personal data to the transport service provider in order to deliver the goods.

The online store sends newsletters, offers and other similar kind of marketing information to the Buyer’s e-mail address only if the Buyer has given a consent for that while making the order or on the Buyer’s web / marketing channels.

The Buyer is able to opt out of offers and newsletters sent to their e-mail address, mobile devices etc at any time by letting us know via e-mail or by following the instructions in an e-mail containing an offer.

The Buyer’s information will not be given out to 3rd parties for marketing / contacting purposes without the explicit consent of the Buyer. The Buyer has the right to request that the Seller delete the Buyer’s data from its database.

7. Settlement of disputes

All complaints by the Buyer must be in the written format and sent to the e-mail: luminataofficial@gmail.com.

In addition to these General Conditions of Sale and the Data Protection & Privacy Policy: marketing & processing of personal data, both the Buyer and the Seller, are protected by the laws of the Republic of Estonia and those of the European Union. The interests of the Buyer are also protected by the Consumer Protection Board.

Luminata Store (and its representative MiBrand OÜ) will resolve any disputes with its customers in a peaceful manner and by means of negotiations. If the parties are not able to find a suitable solution, they have the right to turn to the Consumer Protection Board or to Tallinn City Court. The Buyer may also turn to the dispute resolution bodies of the European Union.
